LENDTREX PRIVACY POLICY Business-to-Business SaaS Privacy Notice Funder LLC d/b/a Lendtrex September 2026 This Privacy Policy explains how Funder LLC, doing business as Lendtrex, handles personal information in connection with Lendtrex websites, sales, onboarding, account administration, support, and the operation of the Lendtrex service. Effective September 2026.

1. Scope

This Policy applies to information Lendtrex collects about prospective customers, customers, authorized users, website visitors, support contacts, and other business contacts. This Policy does not replace a Customer’s own privacy obligations to borrowers, prospects, lenders, referral partners, employees, or other persons whose information the Customer places into Lendtrex. For Customer Data processed on behalf of a Customer, the Customer generally determines the purposes and means of processing and the Data Processing Addendum governs Lendtrex’s processing obligations.

2. Information We Collect

Depending on how you interact with us, we may collect:

  • Business identity and contact information, such as name, company, title, business address, email address, and telephone number.
  • Account and authentication information, such as user IDs, access permissions, login metadata, and security events.
  • Billing and transaction information, such as subscription status, invoices, payment status, and limited payment-related metadata received from payment providers. We do not intentionally store full payment-card numbers in general CRM fields.
  • Customer configuration information, including branding, website information, calendars, notification settings, connected-service configuration, and account preferences.
  • Support and communications information, including support requests, emails, calls, messages, meeting notes, and troubleshooting information.
  • Usage and device information, including log data, IP address, browser or device information, feature interactions, diagnostics, cookies, and similar technologies.
  • Customer Data processed on behalf of customers, which may include borrower/prospect contact information, property or financing information, referral contacts, lender contacts, uploaded documents, communications, and other business records.

3. How We Use Information

We may use information to:

  • provide, provision, configure, secure, maintain, and support Lendtrex;
  • process subscriptions, billing, and authorized usage charges;
  • authenticate users and administer accounts;
  • provide websites, CRM functionality, communications, automations, reporting, and integrations;
  • respond to support requests and troubleshoot problems;
  • evaluate the Founding Pilot and improve standardized product functionality;
  • monitor fraud, abuse, security, carrier, and compliance risk;
  • communicate about service changes, billing, security, support, and product updates;
  • comply with law, enforce agreements, protect rights, and maintain business records.

4. Customer Data

As between Lendtrex and the Customer, Customer Data remains owned by the Customer or the relevant data subject as applicable. Lendtrex processes Customer Data to provide the service and as otherwise permitted by the Customer Agreement and Data Processing Addendum. Lendtrex does not acquire ownership of a Customer’s borrowers, prospects, lenders, referral partners, or business relationships merely because their information is stored in Lendtrex.

5. How We Disclose Information

We may disclose information to service providers and subprocessors that help us operate the service, including HighLevel, telecommunications carriers, email providers, cloud/hosting providers, payment processors, calendar providers, domain/DNS providers, analytics providers, AI providers when enabled, and professional advisers. We may also disclose information when required by law; to protect rights, safety, or security; in connection with a merger, financing, acquisition, reorganization, or sale of all or part of the Lendtrex business; or with the applicable person’s or Customer’s direction or consent. We do not sell Customer Data for money. We do not use Customer Data for cross-context behavioral advertising.

6. Cookies and Similar Technologies

Lendtrex websites may use necessary cookies and similar technologies for authentication, security, preferences, analytics, and service operation. Where required, additional notice or consent mechanisms may be provided.

7. Data Retention

We retain information for as long as reasonably necessary to provide the service, administer accounts, maintain business and tax records, resolve disputes, enforce agreements, meet legal obligations, protect security, and support backup and disaster-recovery processes. After account termination, supported Customer Data may remain available for an offboarding period described in the Customer Agreement. Backup copies may persist temporarily until overwritten under normal backup-retention cycles.

8. Security

We use commercially reasonable administrative and technical measures appropriate to the services we control. No internet-based system is completely secure, and we cannot guarantee absolute security. Customers are responsible for authorized-user management, credential security, connected accounts, device security, lawful data collection, and avoiding unnecessary placement of highly sensitive credentials or information into general-purpose CRM fields.

9. Data Incidents

If we become aware of a security incident involving Customer Data, we will investigate and provide notices required by applicable law and the Data Processing Addendum. Customers are responsible for providing current security and legal-contact information.

10. Your Choices and Rights

You may update business-contact and account information through available account features or by contacting us. Depending on applicable law and the nature of our relationship, individuals may have rights to request access, correction, deletion, or other treatment of personal information. When Lendtrex processes personal information solely on behalf of a Customer, requests concerning that Customer Data should generally be directed to the Customer. We may refer requests to the relevant Customer.

11. Communications

Service, billing, security, and account communications are transactional and may be necessary to provide the service. Marketing communications, where sent, will include legally required opt-out mechanisms.

12. Children’s Information

Lendtrex is a business service and is not directed to children. We do not knowingly solicit personal information from children through our sales or account-registration processes.

13. Third-Party Services

Lendtrex may link to or integrate with third-party services. Their privacy practices are governed by their own policies.

14. Changes to this Policy

We may update this Policy to reflect service, legal, operational, or technology changes. Material changes will be communicated where reasonably practical.
